General Terms and Conditions
Here you will find the General Terms and Conditions of LaVita Swiss GmbH.
These General Terms and Conditions (GTCs) apply to all deliveries and services, unless they contradict statutory requirements.
The General Terms and Conditions (hereinafter referred to as "GTCs") apply to all current and future deliveries and other services, including consulting services of LaVita Swiss GmbH, CH-8593 Kesswil, Switzerland, even if LaVita Swiss GmbH does not refer the customer to these GTCs again in subsequent transactions.
No separate order conditions apply to the first order.
The prices stated at the time of ordering apply to delivery. Delivery shall be made in accordance with the specified method of payment and all prices quoted are inclusive of VAT.
Compensation for damages is excluded except in cases of gross negligence. We will inform you immediately if the goods are unavailable, and the delivery time will be extended by circumstances for which we are not responsible, such as strikes, legal or official orders, force majeure, etc. We will inform the customer of such obstacles immediately. The customer may then cancel his order.
We may determine the type of dispatch, the dispatch route and the company commissioned with the dispatch at our discretion, unless the customer gives express instructions.
The shipping costs are included in the sales price.
Complaints must be reported to us within 3 days of receipt of the goods.
Exchanges or returns will only be accepted if there is evidence of incorrect delivery and must be made within 14 days of receipt of the goods. The customer shall bear the costs of returning the goods and no exchange or return will be accepted if the original packaging has been opened or damaged.
Should you fall into arrears with your payments, we reserve the right to charge you interest on arrears at a rate of 5 (five) per cent above the respective base interest rate announced.
The goods remain the property of LaVita Swiss GmbH, CH-8593 Kesswil, until full payment has been received.
